The thesis titled ””Joint Responsibility of Employees in Subcontracting and Contracting Agreements - A Comparative Study”” discusses the joint liability of workers in subcontracting and contracting agreements, especially civil liability, and analyzes and compares the legal and judicial positions regarding this in French and Egyptian law.The thesis sheds light on the concept of joint responsibility, which includes the joint liability of the worker and employee for damages caused during work performance, and analyzes the legal basis for this responsibility and the requirements for proving it.Additionally, the thesis discusses the differences between French and Egyptian law regarding the joint responsibility of workers in subcontracting and contracting agreements, and analyzes legislation and judicial cases in both countries. The researcher reached some important results and recommendations in this regard.The thesis delves into the concept of joint responsibility in subcontracting and contracting agreements, which involves both the worker and employee’s joint liability for damages caused during work performance. The thesis identifies the basis for this liability and the requirements for proving it, including determining the joint parties and the scope of their responsibility and evaluating damages resulting from work.By analyzing the laws and judicial cases in French and Egyptian law, the thesis reveals the differences between the two countries regarding the joint responsibility of the worker and employee in subcontracting and contracting agreements. These differences were tested through analyzing several judicial cases in both countries that highlight the practical application of joint responsibility.The thesis concludes with several important results and recommendations, including the necessity of clear and detailed legislation that regulates joint responsibility in subcontracting and contracting agreements, ensuring the protection of the parties’ rights and achieving equality among them. Additionally, the thesis highlights the need for the contracting parties to consider joint responsibility when setting contract terms and determining matters related to insurance and financial guarantees.”
