There is no doubt that the aspect in which justice is embodied is the judiciary, as the judiciary is a symbol of the sovereignty of nations and evidence of their independence, and the history of the judiciary in each nation indicates its progress and development. Therefore, Islamic Sharia and contemporary laws focused on the means of proof because they are the effective tool in achieving justice. Evidence, whether in Islamic jurisprudence or in contemporary laws, is establishing evidence that the crime occurred or did not occur and attributing it to the accused or his innocence of it. Although there are general rules governing the process of proof in the case mechanism, evidence in criminal matters is characterized by special features in several aspects that require subjecting it to a special legal system. And because proof is to establish evidence with the authorities competent in criminal procedures on a fact of legal importance, the scope of criminal proof is not limited to establishing evidence before the judgment judiciary only, but extends to include its residence before the investigation authorities, but also the inference authorities, because establishing evidence includes the search for Evidence, then submitting it to the competent authorities, and then estimating its strength in proof. The court cannot prove the incident itself, but it must seek the assistance of means to prove the incident. These means are the evidence, and the evidence is one of these means. Evidence has a prominent role in criminal proof, whether in Islamic jurisprudence or contemporary law, where Islamic law knew the presumption as a means of proof, and we have what was mentioned in the story of our master Yusuf, peace be upon him, the best evidence as not cutting the shirt was the witness to his innocence.
