Man has known the phenomenon of asylum since ancient times, as he was subjected throughout the ages to various types of torture and persecution, which made him flee that persecution and torture to search for a place and refuge in which he could secure his life.
Although the phenomenon of asylum is as old as human, the legal rules, or what we can call today, international refugee law, only recently emerged, specifically with the beginning of the twentieth century, and that was the result of the emergence of large numbers of refugees, which prompted the international community to adopt Many agreements have defined the concept of a refugee and regulated his rights and obligations, in addition to international refugee law, international humanitarian law comes, which plays an important role in providing protection for this vulnerable group in times of armed conflicts, whether international armed conflicts or non international armed conflicts.
The refugee issue raises many problems, concerns, difficulties and complications, as it is a complex issue and linked to other issues, foremost of which are issues of religious or political persecution. These issues may result in the flight of refugees, which may take place in huge numbers from their countries of origin to another country to escape from persecution and torture.
Hence, the refugee becomes vulnerable to losing all types of international protection, as he lacks the protection of his country of origin from which he fled because of persecution and torture, on the one hand, and on the other hand, he also lacks the protection of the country of refuge to which he fled to search for a safe place and refuge, Hence, it was incumbent upon the international community to intervene to extend the legal protection for this refugee, by establishing an international legal system that works to provide protection for this vulnerable group of people.
The matter becomes even more important in light of the increasing number of refugees at the present time, especially in light of the Syrian civil war. By the year 2015, more than six million Syrian refugees had been registered in neighboring countries, especially Jordan, Lebanon, Turkey and Iraq, and it is likely that there are tens of thousands of other unregistered refugees.
This study focused on ”Refugee Protection in Periods of Armed Conflict - An Empirical Study on Syrian Refugees”, the study reached a number of results:
1) there are three branches of public international law that may be applied to Syrian refugees: international human rights law, international humanitarian law, and international refugee law.
2) The solution of the Syrian refugee problem lies in solving the real causes that have exacerbated the phenomenon of asylum, and therefore, first and foremost, satisfactory solutions must be found in order to end the conflict and the ongoing conflict in Syria.
3) It should be noted that the United Nations 1951 Refugee Convention is characterized by limited obligations on states.
4) The United Nations Convention Relating to the Status of Refugees of 1951, in addition to its protocol issued in 1967 AD, are considered as the legitimate basis, which defines standards for dealing with refugees.
5) The Arab Convention filled a major gap in international refugee law, which is represented in the non-applicability of the description of a refugee to those who commit a terrorist crime, and this text is an updated text that has no parallel in the 1951 United Nations Convention on Refugees, which was confined to excluding the perpetrators of war crimes, Or crimes against humanity or serious non-political crimes from enjoying refugee status.
