This study appoints the civil liability for the producer and installer doctor for the prostheses medical devices in the Latin and Anglo-American laws , whether the liability came from the breaching of duties and obligations by producer or installer doctor .
The study indicated who’s response for the damages cause by the prostheses devices and indicated who is injured, the study also indicated what does it mean with medical devices, prostheses, what is the defect prostheses device, what is the dangerous prostheses device , and the obligations for the installer doctor and producer .
The study included the nature of civil liability for the prostheses devices producer, and installer doctor, by using the traditional division of the civil liability with common law, and what the judgment do to interpretation of legal texts because of vacuity of legislation, which caused the legislator to find a new way to establish the civilian liability without fault .
The study included the indemnity for the damages caused by prostheses devices, and include the limit for the indemnity as well as the punitive and treatment penalties . The French legislator tended to legalize the process of establishing warranty funds , and its effects that caused in the necessary of legislator interfering in order to put a cap for indemnity which will be useful for ending the problem of increased insurance installments .
