المستخلص
تتكون الرسالة من تمهيد وأربعة فصول وخاتمة. التمهيد تحدثت فيه عن تعريف النبات والزرع والثمار ثم ينبت رعاية الإسلام للبنات. أما الفصل الأول. فكان بعنوان الزكاة في الأصناف النباتية وذكرت مشروعية زكاة النبات من القرآن الكريم والسنة وإجماع العلماء. ثم تحدثت عن وقت وجوب إخراج زكاة النبات ومقدار نصابها.
ثم تحدثت عن بيع النبات بشكل عام والأدلة الواردة فيها من القرآن الكريم والسنة النبوية ثم تحدثت عن بيع الثمار وذكر أحكام بيع الثمار قبل ظهوره وبعد ظهوره ثم حكم بيع الثمار بعد ظهوره ولكن قبل بدء الصلاح. وحكم بيع الثمار بعد بدء صلاحه. ثم تكلمت عن بيع الثمار المشروط بشروط معينة وهذه الشروط هي بيع الثمار بشرط القطع فورا، وبيعها بشرط التعبئة، وبيعها مطلقا، وقد دارت آراء الفقهاء مشروعيتها.
ثم تكلمت عن الأحكام الخاصة بالنبات وهي المزارعة والمساقاة وبيع النسيئة وتحدثت بالتفصيل آراء الفقهاء في حكمها ورجحت منها ما سانده الدليل. وقد عرفتها لغويا واصطلاحيا.
أما الفصل الأخير. فهو حول القضايا المعاصرة في أحكام النبات
1- هي حكم تناول النبات المغذي على التماسه وكذلك المسقى من مياه الصرف الصحي المعالج. ويثبت ما قاله المختصون في هندسية المياه ثم ينبت الحكم الفقهي فيها مستندا لما ذهب إليها الهيئات الشرعية والفقهية المعاصرة.
2- حكم استنساخ النبات وقد مهدت له بتعريف الاستنساخ وأنواعه وطرقه ثم ذكرت استنساخ النبات بشكل خاص وهو استنساخ تقليدي معلول به قديما واستنساخ تعيني معاصر وهو الاستنساخ الجيني للنبات. وتكلمت عن زراعة الأنسجة النباتية وتحدثت عن خطواتها العلمية وفوائدها على النبات والإنسان والبيئة. ثم ذكرت الفقهي فيها واستدليت بما ذكرته الهيئات الفقهية المعاصرة حول حكمها.
3- حكم مقدار زكاة النبات الذي سقي من المطر الصناعي. وقد بنيت كيفية استمطار السحب والخطوات العلمية المتبعة لها.
ثم ببعث الحكم الشهري لعملية استمطار السحب وبنيت مقدار زكاة النبات المسقي من المطر الصناعي.
ثم أخيراً. ذكرت النتائج التي توصلت إليها. وأرفقت هذه الرسالة بالفهارس العلمية مشتملة على فهارس الآيات والأحاديث والأحلام والمراجع والفهارس والمواضيع
The thesis consists of four chaptersand conclusion the introduction in which I discussed about defining the plants the plantations the fruits then I showed how islam cares for the plants but in the first chapter it was shown the title for the tribute on the plants items I referred to the legality of plant tribute in Quran and Sunna the consenus of the scholars the timing of paying the plants tribute and its share then I discussed selling the plants in general the proofs referring to it of both Quran and Sunna then I talked about selling the fruits and mentioned the rules for selling the cropos before its appearance and after its appearance the the rukle of selling the crops after its appearance but before the starting of the fitteness then I talked about selling the crops in terms with certain conditions these conditions are selling the crops in term of immediate cutting selling them on term of retaining absolute selling the discussion for the prosepectives of the scholars and its legality.
Then I discussed about the private rules for the plants which are cultivation watering and selling, I discussed in detail about the prespectives of the scholars in rules and I prfered what was supported with with evidence. I defined them lingustical & terminologically but in the last chapter it is about the recent cases in the rules of plants
It is rules that deal with the feeding plants on the impurities also that are watered with the waste drainage treated water I also showed what was said by those who are specialized in the water engineering then I showed the fikh rules basing on what the recnt legal authorities agreed upon recently .
• The rules for geneting the plants I paved to it by defining genetating in general its types its methods then I mentioned geneting the plants in cetain shape which is classical geneting that is working since old times technical geneting recently which is the geneting of the plants I discussed cultivating the plants tissues I talked about its scientific steps its benefits for the plants -the human being& the environment I referred to the fikh rules I got the evidences and proofs from what were mentioned by the recent fikh bauthorities around its rules
• * the rules for the amount of plants tribute that is watered by the artifical rainings I a;lso showed how to bring the rains of the clouds the scientific steps followed for it I also showed the legal rule for the process of bringing the rains of the clouds also showee the amount of the plants tribute got through the industrial raining lastly imentioned the results that I attain enclosed with this thesis the scientific index including the index of the versions the traditions the prominent scholars
